You’ve probably heard that cannabis is now legal.
Well sort of.
It’s actually not legal at the federal level which creates a plethora of issues when running a cannabis business. You don’t want to be an outlaw. That’s not good business.
In this episode we visit with Justin Walsh, a partner with Gleam Law, and discuss when is the right time to reach out to a lawyer. We also talk regulation and where the industry is going
Ounce of Prevention in Cannabis Law
According to Justin, it’s better to take steps before problems get out of control. And ounce of prevention is worth more than a pound of cure. Gleam Law only works with cannabis clients. If a business touches a cannabis plant, their a good candidate for a client.
Legal situations and challenges include:
- Regulatory violations
- Formation of a business
- Framing initial contracts
- Partnerships
- Banking
- Intellectual Property
Justin emphasized it’s better to avoid litigation buy setting up a business right before something goes wrong.
Cannabis Rolodex
Justin says he loves finding innovative solutions for working around regulations. Gleam Law has relationships with the regulation boards. They teach regulation bodies and show how the law works and what is a violation and what isn’t. What results are clients seeing? Problems fixed. Justin is a litigator, but he can usually guide situations into mediation and avoid the cost of a court case.
We talked a bit about the future, where will the industry be in the next 6 months. He sees CBD regulation getting a higher profile e.g. Charlottes Web FDA denial of NDI (New Dietary Ingredient) status Hopefully government take a more business friendly.
